1. Scope and Contracting Party
These Terms and Conditions apply to all direct bookings made via the official website of LEONE STAYS GmbH, unless otherwise agreed in writing.
Contracting party:
LEONE STAYS GmbH, Switzerland
By completing a booking, a legally binding accommodation contract is concluded between the guest and LEONE STAYS GmbH.
2. Booking and Contract Formation
A booking becomes binding once:
the booking is confirmed, and
full payment has been successfully received
After completion, the guest receives a booking confirmation by email.
LEONE STAYS GmbH reserves the right to decline bookings at its discretion.
3. Prices and Payment
All prices are stated in Swiss Francs (CHF), unless otherwise specified.
For direct bookings:
full prepayment is required before arrival
access to the apartment is granted only after payment
Without full payment, there is no right to access the apartment or receive keys.
4. Cancellation Policy (Direct Bookings)
For direct bookings made via our website, the following cancellation policy applies:
100% refund if the booking is cancelled up to 14 days before arrival
50% refund if the booking is cancelled up to 7 days before arrival
No refund for cancellations made less than 7 days before arrival
In case of no-show, late arrival, or early departure, no refund will be granted.
For bookings made via Airbnb, Booking.com, or other platforms, only the cancellation conditions shown on those platforms apply.
5. Check-in, Check-out and Access
Check-in from 3:00 PM
Check-out by 10:00 AM
Late check-out or interference with housekeeping may result in additional charges.
Access to the apartment is provided via a key safe with a personal access code.
The access code:
appears in the guest portal two days before arrival
is released only after full payment, online check-in, and ID verification
6. Mandatory Online Check-in and ID Verification
Due to legal requirements of the City of Thun, all guests must:
complete the online check-in form in full
upload a valid photo ID (passport or national ID card; driver’s licenses are not accepted)
digitally accept the rental agreement and house rules
If the online check-in is not completed, we reserve the right to:
deny access to the apartment
cancel the booking without refund
7. House Rules (Binding Part of the Contract)
All stays are subject to binding house rules.
The house rules:
are available before booking
must be accepted during online check-in
apply for the entire stay
In case of violations, we reserve the right to:
terminate the stay immediately
charge for damages, extra cleaning, or penalties
refuse any refund
8. Guest Liability and Damages
The guest is responsible for all damages caused during the stay, including:
property damage
missing or damaged items
excessive cleaning requirements
All damages must be reported immediately.
Unreported or intentional damage will be charged in full.
9. Subletting, Sharing and Misuse
Subletting, reselling, or sharing the apartment, keys, access codes, or guest portal access with third parties is not allowed.
The apartment may only be used for accommodation purposes.
The following is not permitted:
parties or events
large gatherings
commercial or business use
commercial photo or video shoots without written approval
Violations may result in immediate termination without refund.
10. Liability of LEONE STAYS GmbH
LEONE STAYS GmbH is liable for damages caused intentionally or by gross negligence.
For minor negligence, liability is limited to foreseeable damages related to essential contractual obligations.
No liability is assumed for disruptions outside our control, including:
internet or Wi-Fi outages
power, water, or heating interruptions
Guests must report issues immediately to allow us to fix them.
11. Internet Use
If internet/Wi-Fi is provided:
availability and speed are not guaranteed
illegal or abusive use is strictly prohibited
This includes illegal downloads, file sharing, or unlawful content.
The guest is fully responsible for any violations and related claims.
12. Lost and Found
LEONE STAYS GmbH is not liable for lost or forgotten items.
Found items are stored for a limited time and then disposed of.
Shipping is only possible upon request and at the guest’s expense.
13. Immediate Termination for Important Reason
LEONE STAYS GmbH may terminate the stay immediately if an important reason exists, including:
violation of house rules
false information during booking or check-in
missing or invalid identification
illegal activities or safety risks
unauthorized sharing of keys or access codes
In such cases, no refund will be granted. Further claims remain reserved.
14. Force Majeure
LEONE STAYS GmbH is not liable for service failures caused by events beyond our control, including:
natural disasters
government orders
utility outages
15. Data Protection
Information about the processing of personal data is available in our Privacy Policy on the website.
16. Applicable Law and Jurisdiction
Swiss law applies exclusively.
Place of jurisdiction is Switzerland.
17. Acceptance
By completing the booking and the online check-in, the guest confirms:
all provided information is correct
acceptance of these Terms and Conditions
agreement to follow the house rules
